School emergency ordinance still in effect

ANN ARBOR, Mich. – Emergency public health orders remain in effect for schools and educational institutions in Washtenaw County.

On Thursday, the Washtenaw County Department of Health released a statement on the legality of its emergency orders for educational institutions.

The department said it received “numerous inquiries” about the orders after Michigan Gov. Gretchen Whitmer signed the fiscal bill for fiscal 2022.

“Although the recently adopted state budget for fiscal year 2021-2022 contains language dealing with the effect an emergency ordinance may have on allocated funds, the Ministry of Health retains the power to issue and execute its emergency orders, ”the health ministry said.

He reiterated that the isolation and quarantine order in educational institutions and the wearing of masks in educational institutions with the Washtenaw County public health orders remain in effect.

The Washtenaw County Department of Health remains committed to protecting public health. The Michigan Public Health Code, MCL 333.2451 and MCL 333.2453, as well as State Administrative Rule R325.175 (4), promulgated by the Michigan Department of Health and Human Services in accordance with MCL 333.2226 (d), authorize the services of local health authorities to issue prescriptions in response to the COVID-19 pandemic. The Ministry of Health has issued its order for isolation and quarantine in educational establishments (dated 09/21/21, updated 09/15/21) and its wearing of masks in educational establishments. education in Washtenaw County (as of 09/21/21) in accordance with this law and the regulatory authority. While the recently enacted state budget for fiscal year 2021-2022 contains language addressing the effect an emergency ordinance may have on allocated funds, the health ministry retains the authority to issue and to fill emergency orders. As a result, the Ordinance of Isolation and Quarantine in Educational Institutions (dated 21/09/21, updated 15/09/21) and its wearing of masks in educational institutions in Washtenaw County (as of 09/02/21) remain in effect in accordance with the provisions of these by-laws.
